Suing Dan Brown (again)

Catholic author Jack Dunn (author of The Vatican Boys) is suing Dan for $400 million, saying his book was plagiarised.

I'd say that if you sue for the first time this late, your case shouldn't even be considered. So, goodbye Catholic author Jack Dunn. Is he looking for the same boost in sales that the others got? I'm not buyin' The Vatican Boys, so there.

Well yes, you don't have to be overly cynical to recognize that the profit motive behind all of these lawsuits stems not from the damage claims or settlement hopes, but from the inexpensive publicity. By accusing Dan Brown of plagiarism, an author gets to tell the world, "I wrote a book similar to something that a whole lot of you read and liked," the subtext being, "so it would be great if you ran out and bought a copy of my book as well."

There's an element of vanity to it as well, of course. If The DaVinci Code is a book that millions of people around the world are aware of, it becomes a title to which an author would love to have his own books linked in the public mindset. If a conversation circle at a party starts talking about The DaVinci Code, invariably someone in the group starts asking, "have you read this other book? People are saying it's just like The DaVinci Code..." The ultimate goal is to become a name that gets mentioned within a sentence or two of Dan Brown, such that the mere mention of Brown's name causes people to think of the controversies surrounding Perdue, Baigent, and...yourself!

Certainly a lot of authors (or more often their publishers) have tried to cash in on the success of The DaVinci Code by drawing flattering comparisons on the back covers of their own novels, to the effect that "if you liked The DaVinci Code, you'll love this book!" Taking it to the level of a lawsuit is a means of marketing above the rest of the pack, now that this market has become saturated.

The truth is, it's a business decision on the part of the author and his publisher. They know the spotlight this will shine on their products, and if they can get enough controversy going to drag this out in the press for a few weeks, they'll get the equivalent of hundreds of millions of dollars of advertising for a few tens of thousands of dollars of preliminary court fees. It never needs to go all the way to trial for this to succeed (it was only done in the Baigent case because both books were owned by Random House, so a "show trial" was advertising theatre). The case doesn't even need to be settled out of court for it to be a successful tactic. So long as the plaintiffs get enough free press out of it, they can quietly withdraw their suit. Brown and Random House could counter-sue for damages, of course, but for all intents and purposes that would be paying for more publicity for a competitor, so they're more likely to just let it go.

slightly off-topic. Baigent and co. appealed. Dan will have to go all the way back to London for another suit, I think. At least the British court-house (I took a DVC tour of London a few days ago and saw it) is Gorgeous!

"The Vatican Boys" if its about what I THINK it could be about though people aren't supposed to talk about THAT even though everyone knows what happens to certain young kids by priests - the guy shouldn't have any problem with book sales. So why attack Dan Brown?

Here we go again. Apparently, Opie has made a dirty movie.

As if there's a shortage of things in Italy to investigate, comes now a group of clergy to the bench in the seaside village of Civitavecchia clogging up the court dockets with a new complaint against The Da Vinci Code.

This time it's the movie, and the priests involved claim that it violates Article 528 of Italy's penal code, because it is "obscene" from a religious standpoint. The complaint names 10 people, including Dan Brown and director Ron Howard.

Why the case is being filed now, more than a year after the film opened all over the world, the state prosecutor said he was not sure. "I don't know, maybe they have just seen the film."

Hopefully the Italian courts have at least as firm a grip on the handlebars of jurisprudence when it comes to the clash of art and lawyers as Justice Potter "I know it when I see it" Stewart did. If not, looks like Dan and Ron could be fined about 163 smackers and spend three months in a Neapolitan pokey.

Now I have no idea what "clergy" these guys are from, but if you go poking around the port of Civitavecchia, you'll come across the La Chiesa di Santa Maria dell'Orazione, the Church of St. Mary of the Oration, and home to the "Confraternity of Death.
